While using Aimz courier, you as 'client' on your behalf or on behalf of any one else are agreed with the terms and conditions, which will apply from the time of acceptance of your order by Aimz courier. These terms and conditions can not be changed or varied unless a director of Aimz courier agrees in writing. Your statuary rights and entitlement under any defined service feature are not affected.

Consignment
Consignment means any item or parcel that Aimz courier agrees to carry for the client at one time from one address to another.

Unacceptable consignments
Unacceptable consignments Aimz courier agrees that its consignment is deemed unacceptable if-
1. It is classified as dangerous goods.Dangerous goods mean those substances as defined in the Road traffic regulations 1992. E.g. explosives, radio active substances etc
2. Aimz courier decides it can not transport an item safely or legally such as money, jewellery, security stamps, precious stones, watches, bullions, living creatures, nuclear fuel, nuclear waste, continental haulage, airport luggage and furniture removals.

Deliveries and undelivered goods
1. Consignments are delivered to the receiver's address given by client but not necessarily to the named receiver personally.
2. The client warrants that any special equipment required for loading or unloading the consignment that is not carried by Aimz courier's vehicle will be provided or procured by client.

Consignment charges and billing
1. Consignment charges are calculated according to the weight and distance. Aimz courier will prepare invoice at least once a month.
2. The charges will be payable on the expiry of any time limit notified to the client (whether on any invoice or otherwise) or failing such notification 30 days after the date of relevant invoice, Aimz courier will be entitled to interest at 8% above the official dealing rate of the Bank of England for the time being calculated on a daily basis on all amounts overdue to the Aimz courier.
3. Any queries as to the correctness of the invoice must be made in writing within fourteen (14) days of issue of invoice otherwise it will be payable in full.
4. All payable charges are exclusive of value added tax, unless stated otherwise.
5. All sums due to the Aimz courier shall be paid without deductions, set off or abatement and the client shall not withhold or defer any payment on account of any claim or counter claim and acknowledges that any such claim or counter claim whatsoever by the client against the Aimz courier must be subject to separate proceedings.

Liabilities for the loss and damage
1. Aimz courier's contract with client on the basis of that Aimz courier's liability is strictly limited to direct loss only.
2. Aimz courier shall not be liable for any loss or misdelivery or damage to bullion, money, jewellery, security stamps, precious stones, nuclear fuel or nuclear waste, airport luggage and furniture removals as determined in accordance with paragraph unacceptable consignments
3. Claims are limited to one claim per consignment settlement of which will be full and final settlement for all loss or damage in connection therewith.
4. Act, omission, misstatement or misrepresentation by the client or other owner of consignment or by servants or agents of either of them.
5. Aimz courier is not liable for any damage caused by improper or insufficient packing.
6. Aimz courier will not be liable for any loss or damage due to insufficient labelling or addressing.
7. Aimz courier will not be responsible for the delay if the consignee not taking or accepting delivery within a reasonable time after the consignment has been tendered.

Time limit for claims
All claims must be submitted in writing to Aimz courier within thirty (30) days from the date of acceptance of consignment by Aimz courier, failing which Aimz courier shall have no liability whatsoever.

Delayed consignment
Aimz courier make every reasonable effort to deliver the consignment according to Aimz courier's regular delivery schedules, but these are not guaranteed and do not form part of the contract. Aimz courier is not liable for any damages or loss caused by delays.

Circumstances beyond Aimz courier's control
1. Aimz courier is not liable for any loss or damage arising out of circumstances beyond Aimz courier's control. These include but are not limited to: Act of God e.g. earthquake, cyclone, storm, flood, fog etc
2. Any consequence of war, invasion, act of foreign enemy, civil war, rebellion, hostilities (whether war or not), military, requisition or destruction of or damage to property by or under the order of any government or public or local authority.

Fraud
The Aimz courier will not in any circumstances be liable in respect of a consignment, where there has been fraud on the part of client, or the owner of consignment or any part there of or by the servants or agents of either of them in respect of that consignment, unless the fraud has been contributed to by the complicity of the Aimz courier or of any staff or Aimz courier acting in the course of his employment.

Governing law
These term and conditions and all contracts shall be governed by and construed in accordance with the law in England and any proceedings in relation there to shall be subject to the exclusive jurisdiction of the English Courts.
